Welcome to Northern Horizons Travel. These Terms of Service ("Terms") govern your access to and use of the Northern Horizons Travel website, products, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not access or use the Services. We may modify these Terms at any time. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. When you make a booking through our Services, you are entering into a contract with the relevant travel service provider (airline, hotel, tour operator, etc.). We act as an intermediary between you and the travel service provider and are not a party to this contract.
All payments are processed securely. By providing payment information, you represent and warrant that you are authorized to use the payment method provided and that you authorize us to charge your payment method for the total amount of your reservation or purchase, including any taxes and fees.
Changes and cancellations are subject to the policies of the travel service provider with whom you have booked. Each travel service provider has its own terms and conditions that govern its relationship with you and the cancellation penalties that apply to your booking. We recommend that you read these terms and conditions carefully before making a booking.
The Services and all content, features, and functionality thereof, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the property of Northern Horizons Travel or our licensors and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use.

WE DO NOT WARRANT THAT THE SERVICES WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THE SERVICES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NORTHERN HORIZONS TRAVEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.
You agree to indemnify, defend, and hold harmless Northern Horizons Travel and our officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.
Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in accordance with the rules of the Canadian Arbitration Association. The arbitration shall be conducted in Vancouver, British Columbia, in the English language.
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms constitute the entire agreement between you and Northern Horizons Travel regarding the use of the Services, superseding any prior agreements between you and Northern Horizons Travel relating to your use of the Services.
The failure of Northern Horizons Travel to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
You may not assign or transfer these Terms, by operation of law or otherwise, without Northern Horizons Travel's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void.
